Following the trial of liability issues in an RTA case, the court made a split costs order. That split also applied to counsel’s brief fee which would be apportioned. The old rule that the entirety of the brief fee becomes payable on delivery of the brief no longer applied rigidly. It was appropriate to treat one third of the brief fee as becoming payable on delivery, with the remainder to be payable for the period of one week before the date the trial commenced.
