Delay occurred in commencing detailed assessment proceedings, which should have been started by 30 June 1999 but were not begun until 1 July 2004. The issue on the appeal was whether a proportion of the receiving party’s costs (in addition to interest) should be disallowed on account of the delay.
The court held that there was no case for imposing on the receiving party any further sanction beyond disallowance of interest, which itself was a substantial sum being 8% on £327,000 over five years.
