The court refused to permit the defendant to raise before the Costs Judge allegations of negligence which should have been litigated in the Queens Bench Division after the Master had stayed the detailed assessment for this purpose. Johnson v Gore Wood [2002] 2 AC 23 applied.

Permission to appeal was obtained from the Court of Appeal but the appeal was settled before this could be heard.
