The court took the opportunity to helpfully spell out the changes to practice in the Court of Appeal which came into force the day following the judgment (on 30 June 2004) following the extensive amendments to the Practice Direction to CPR Part 52. In addition to helpfully spelling out the changes which the new Practice Direction has introduced the court made it very clear to practitioners that failure to comply with a new practice will have serious repercussions for them and potentially for the parties they represent. This decision, the full text of which is to be found at [2004] EWCA (Civ) 835 should not be confused with the case of the same name reported at [2004] 4 All ER 653 (CA) which is a report of the substantive appeal.
