What we do

The QB Judge’s listing Office is responsible for:

Trials

Obtaining a trial date

Once you have received an order from a Master assigning your case a trial window, you should send a copy of that order to our office. We will accept copies by post or fax.

Once the order has been received, we will assign the case a listing number and inform all parties of an appointment to fix the trial date. At that appointment, counsel’s clerks from all sides will attend this office and the trial will be listed in the window assigned by the Master.

If you are unable to attend the appointment, please send to this office your dates of availability within the trial window and we will fix a date in your absence.

Once the trial has been listed, we will send written confirmation of the date to all sides.

The Listing fee

The trial fee (£1000) is required from the claimant’s solicitors when the pre-trial checklists are returned. The fee for Lodging the Pre Trial Checklist is £100, which is non-refundable in the event of a trial settling before being heard in court. Cheques should be made payable to HMCS .

The Pre Trial Checklist

Pre trial checklists are sent out by this office to all parties approximately 10 weeks before the trial date. A letter enclosed will inform the party of the date when the checklist should be returned.

For further information about the Pre Trial Checklist (of Listing Questionnaire), please refer to CPR Part 29.

Effective Letters

Approximately 2-3 weeks before the trial, this office sends a letter out to the parties asking whether the case is still effective, if the time estimate for the trial has changed and whether any special requirements are needed in respect of the trial (for example disabled access). If any special requirements are needed, please inform this office as soon as possible and we will provide you with the necessary information or will ensure that your request is complied with.

List publication

Our Daily List is normally compiled between 2 and 3 o’clock each day. The list will normally appear on our website between these times. Alternatively you can contact our office for the information.

Other Information

Pre Trial Reviews

Should the parties require a pre trial review, counsel’s clerks from both sides should contact this office with dates of availability and a date will be arranged.
If a party wishes to apply for a pre trial review and the other party does not consent, an application notice must be issued.

Trial periods

When the trial date has been arranged, the case will normally be placed in a five-day window. This office will aim to list the trial on the first day of the window, however if this cannot be done, this office will aim to list the case on the second day of the window. This office has a maximum of 5 days to list the case (for example if the trial period commences on a Monday, this office has until the Friday to list the case). It should be pointed out however that the vast majority of trials commence on the first or second day of the window

There are occasions where this office will give a trial period of three days. These are normally reserved for trials with short time estimates.

Applications

This office issues and lists the following applications:

Issuing an application

The fee for an application is £40 if you are applying without giving notice to any other party and £75 if you are applying with notice.

The application notice form N244 must be completed and four copies should be sent to this office. This office will retain two copies (one with the fee endorsed) and will send back the two remaining copies (one for the issuing party and one for service). Additional copies will be sealed if requested.

Application notices are normally listed with a time estimate of no longer than one hour, however additional time will be given if both parties consent to a longer hearing and the court is able to accommodate this.

Defamation application notices

Any application notice which requires a defamation judge will normally be placed in the Warned List. The parties involved will normally be given at least two weeks notice before the application enters that list and arrangements should be made with this office to fix an appropriate date.

Appeals

This office will list appeals once they have been placed in the Warned List by the Appeals Office. The parties should contact this office before the appeal enters the list to arrange an appropriate date.
