Deciding on deferrals and excusals

Deferral and excusal applications are considered by summoning officers. This is done on individual merit and is done carefully, sympathetically and with regard to individual circumstances.

Officers dealing with applications adopt a policy that is both fair to the individual and consistent with the needs of the court, i.e. providing a representative jury. Officers therefore can refuse a request if no good reason is given.

Under Section 8 (1) of the Juries Act 1974 a person who has served or attended as a juror during a period of two years prior to the service of the summons is entitled to excusal as of right because of their previous jury service.
