Appeals Against Conviction/Sentence for Offences Committed Against the Companies Act

The Resident Judge at Cardiff, with the agreement of the Presiding Judges, has directed that where an appellant, of his own initiative, requests transfer to his home court of an appeal against findings under the Companies Act, then that application shall be granted.

We are not to invite applications by, for example, suggesting to appellants that they request transfer. The request must come from the appellant.

Where such a request is received, then the file should normally be passed to the listing officer or myself so that transfer can be arranged.

If an application is made in court (which should rarely happen), then court clerks should advise the Judge concerned of this direction.
