Explanation and Expression of Regret to Witnesses


Where a case listed for trial has not proceeded and been put off to another day for whatever reason, witnesses in that case who have attended should be offered an explanation as to why the case cannot proceed and regret expressed to them that they have been inconvenienced.

The explanation and expression of regret should be given to them in open court by the Judge in whose court the case was listed.

Care should be taken to ensure that any on-going trial is not prejudiced in the process. If necessary the jury in that trial should be asked to leave court whilst explanation and expression of regret is made.
