Defining Issues: Claimants were fitted with a Hylamer Ogee Acetular Cup during hip replacement surgery, and it is alleged in each case that the hip replacement has subsequently failed and that the Product was defective pursuant to sections 2 & 3 of the Consumer Protection Act 1987 and that its safety was less than persons generally were entitled to expect. The earlier failure of the hip replacement is asserted by the Claimants to have been caused or materially contributed to by a defect in the Product, namely that it had a greater tendency to wear than was appropriate in the light of its intended purpose and other related factors
